How long does Maine suspend a driver’s license for an OUI-DUI?

Maine does not automatically suspend a driver’s license when charged with an OUI, unless the driver refused a blood or breath test. The Maine Bureau of Motor Vehicles (BMV) will send a notice of administrative suspension for 150 days for a first offense OUI, 3 years for a 2nd offense OUI, and 6 years for a 3rd offense OUI. If a timely hearing is requested, the BMV will stay the suspension of the license pending the outcome of the hearing.

A work license is available for a first offense OUI Motor Vehicle Bureau (BMV) suspension when a breath or blood test was taken. A work license is available after 180 days of a first offense BMV suspension on a breath or blood refusal. A work license is not immediately available for a court imposed OUI suspensions, except a driver is eligible for a work license after 100 days of a first offense OUI suspension if certain requirements are satisfied.

If your driver license is suspended for a OUI, whether by the court or BMV, you most complete the Driver Education and Evaluation Programs (DEEP) and pay a $50 reinstatement fee to the BMV before you can be reinstated as active following the suspension period.

A driver can obtain an Ignition Interlock Device (IID) after 30 days on a 1st offense suspension, after 9 months of a 2nd offens suspension, and after 3 yeas for a 3rd offense suspension. The driver is required to complete the DEEP requirements and pay a reinstatement fee before being eligible for an IID.
