OUI Charges and CDL Suspension.

If you hold a commercial driver’s license (CDL), a Maine OUI conviction can result in a one year CDL suspension for a first offense OUI, and a lifetime suspension for a second offense OUI.

The Federal Motor Carrier Safety Administration (FMCSA) regulations consider a CDL driver to be driving under the influence of alcohol if their BAC is 0.04 percent or higher while operating a commercial vehicle.

You do not need to be operating a commercial vehicle in order to lose your CDL. An OUI conviction, or BMV adjudication, that you were operating a non-commercial vehicle with a BAC of 0.08 or higher will result in a suspension of your CDL.

Hunter has experience defending OUI charges and CDL license holders before the Maine courts and BMV.

The Law Office of Hunter J. Tzovarras helps people charged with OUI DUI in the Maine courts. Please contact us if you have been charged with an OUI.
